General

 This Consent and Release Agreement is governed in accordance with the laws of the Commonwealth of Massachusetts without regard to its choice of law provisions. Any action or proceeding arising out of or related to this Release shall be brought only in the state or federal courts in Boston, Massachusetts. In the event that any provision in this Release is held to be invalid, illegal or unenforceable in any respect, the remaining provisions shall be given full force and effect.

I, FOR MYSELF OR FOR MY MINOR CHILD STUDENT (IF APPLICABLE), ACKNOWLEDGE THAT I HAVE READ THIS RELEASE AND WAIVER AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I FOR MYSELF AND FOR MY MINOR CHILD STUDENT (IF APPLICABLE) HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.  

If I or my minor child are taking more than one class at Imperfect Art Studio at this time or take other class(es) in the future, this form will apply to participation in such other class(es) unless a new form is subsequently signed and submitted. 

Assumption of Risk & Release of Liability

I, for myself and/or as parent/guardian for the minor child Student named above (if applicable), hereby authorize the student to participate in classes, workshops and related activities (collectively called the "Program") at Imperfect Art Studio, a program of PAIOL ENTERPRISE, LLC. This is a legally binding Consent and Release Agreement (this "Release"), made voluntarily by me, the undersigned with informed consent, and in consideration of the permission of the above-named student to participate in the Program and use the facilities at Imperfect Art Studio, a program of PAIOL ENTERPRISE, LLC,

I for myself and for my minor child Student (if applicable) hereby RELEASE, WAIVE, and DISCHARGE Imperfect Art Studio and PAIOL ENTERPRISE, LLC, its directors, trustees, employees, officers and agents, including without limitation its teachers and staff, and each of their heirs, successors and assigns (collectively, "Releasees") from any and all liability for any and all loss, injury, cost or damage, and any claim or demands therefor on account of injury to person or property or resulting in the death of the student arising out of or related to the Program or while at Imperfect Art Studio or PAIOL ENTERPRISE, LLC facilities, whether caused by the negligence of any of the Releasees, the Student or otherwise (collectively "Damages").

In addition, I COVENANT NOT TO SUE any of the Releasees based upon any claim arising out of or in connection with Student's participation in the Program or while at Imperfect Art Studio or PAIOL ENTERPRISE, LLC facilities.

I ASSUME FULL RESPONSIBILITY FOR any Damages arising out of or related to the student’s participation in the Program whether caused by the negligence of Releasees or otherwise. I acknowledge that I am freely and expressly assuming and accepting any and all risk of Damages in connection with the student’s use of Imperfect Art Studio's facilities and participation in the Program.

I AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS the Releasees and each of them from (i) any claims, liabilities or Damages that the Student may cause to persons or property during the Student's participation in the Program or while using the Imperfect Art Studio or PAIOL ENTERPRISE, LLC facilities, and (ii) from any Damages they may incur due to claims brought against the Releasees arising out of the student's participation in the Program whether caused by the negligence of the Releasees or otherwise. This includes, but is not limited to, any and all claims for Damages that may in any way arise out of use of the Imperfect Art Studio's or PAIOL ENTERPRISE, LLC's facilities, equipment, tools, or materials, or those tools or materials brought or provided by the student or other students.

I UNDERSTAND AND ACKNOWLEDGE that there could be special risks associated with participation in the Program, depending on its nature, since Student may work with (if used) or have access to potentially dangerous artistic tools, equipment, materials and supplies including, but not limited, high heat kilns, paints, glazes, stains, oxides, scissors, pin tools, metal ribs, and other art supplies or tools. I understand and acknowledge that some art tools, equipment, materials or supplies used in the Program could cause Damages. I further understand that Imperfect Art Studio and PAIOL ENTERPRISE, LLC cannot provide an allergy-free environment and assume all risks as such of Student's participation in the Program.

USE OF PHOTOS, VIDEOS, AND IMAGES I understand that from time-to-time Imperfect Art Studio and PAIOL ENTERPRISE, LLC produces promotional material relating to its programs. Without additional compensation, I, for myself or my minor child Student (if applicable) hereby assign, transfer and grant without reservations or limitations Imperfect Art Studio and PAIOL ENTERPRISE, LLC, its successors, assignees and licensees the exclusive right to take photographs and videos of me or my minor child Student participating in the Program to use for Imperfect Art Studio's or PAIOL ENTERPRISE, LLC's business purposes and to use the Student's voice, likeness and biographical material (but not name or address) about the Student in connection with the advertising and promotion of the Program, for both broadcast and non-broadcast purposes in all media, including video, print and online, in such manner and at such times as Imperfect Art Studio or PAIOL ENTERPRISE, LLC in its sole discretion, may deem appropriate or desirable, provided that such use relates to the Student's status as a participant in the Program. I, for myself or my minor child Student (if applicable) hereby waive all right of inspection and release Imperfect Art Studio or PAIOL ENTERPRISE, LLC from any and all liability arising out of any such use of the student’s voice, likeness and/or biographical material about the student for purposes set forth herein.  

MEDICAL EMERGENCIES In the event that the Student needs first aid or emergency medical treatment as a result of an accident, illness, or other health condition or injury, I, for myself or my minor child Student (if applicable), hereby authorize and consent to the Student's transportation to a medical provider or facility at the sole discretion of Imperfect Art Studio or PAIOL ENTERPRISE, LLC staff. I absolutely and unconditionally agree to indemnify and to hold Imperfect Art Studio and PAIOL ENTERPRISE, LLC harmless from all liability, costs, charges, and fees in connection therewith, or any Damages resulting therefrom.

For Minor Child Students

I understand that I am responsible for timely dropping off and picking up my minor child Student. Imperfect Art Studio and PAIOL ENTERPRISE, LLC will only release a minor child Student to the parent or guardian who has signed a form (collectively "Authorized Adult"). If the person picking up the minor child Student is NOT the parent or guardian, then I must inform Imperfect Art Studio in writing beforehand. All Authorized Adults picking up a minor child Student will be asked for photographic identification.

 MEDICATION AUTHORIZATION FOR MINOR CHILD STUDENTS I hereby give permission for the following medications to be administered to my minor child Student if necessary due to injury and/or illness, according to my written instructions or otherwise the manufacturer's recommendations, by Imperfect Art Studio or PAIOL ENTERPRISE, LLC staff and subsequently release Releasees from any and all liability for any damage, injury, or death caused by the administration of the below medication whether due to negligence by Releasees or otherwise.

I understand and acknowledge that Imperfect Art Studio does not have medical personnel on staff and the medication below will thus be administered by a non-medical Imperfect Art Studio staff member. If your child has medication, limitations or special needs, or if there is anything else you would like us to know about your child, please send the information in writing to the Office, or call the Office at tel. 508-685.9697 to speak with the office staff to determine if the needs of your child can be accommodated. We make no guarantees that special needs can be accommodated.

 Studio Access & Boundaries

To ensure a safe and organized learning environment, all students must remain within the designated classroom space for the duration of the class. Access to other areas of the home, including hallways, kitchen, and private rooms, is strictly prohibited without prior approval. If a student needs to use the restroom or any space outside the designated classroom, they must request permission from the instructor before leaving the class area.

Failure to adhere to this policy may result in dismissal from the class without a refund.

Acknowledgment of Pets & Allergies

Imperfect Art Studio is home to a dog and cats. While we maintain a clean environment, we cannot guarantee an allergy-free space. By enrolling in a class, students acknowledge the presence of animals and accept that we cannot accommodate pet-related allergies. Students are responsible for taking necessary precautions if they have sensitivities to animals.

Please note that the dog may occasionally bark. However, if a student feels uncomfortable around dogs, we will ensure that the dog is kept in a separate area during the class.

Payment Policies

  • Imperfect Art Studio does not pro-rate classes for any reason.

  • Class tuition must be paid in full in order to complete your registration and book your classes.

  • If you need to cancel a class, you must do so 24 hours in advance; a $50 cancellation fee will be deducted from the refund if cancellation is done in less than 24 hours.

  • No refunds will be issued after the class has begun.

  • Full refunds will be made if Imperfect Art Studio cancels a class for any reason unless you agree to reschedule for another date.

  • Make-up classes will be offered for classes that do not meet due to weather cancellations or instructor cancellations, but not on a person-by-person basis.

  • Class tuition will not be pro-rated for student absences for any reason.

Code of Conduct

Imperfect Art Studio operates within a private home, and students are expected to behave respectfully at all times. This includes:

  • Speaking and acting respectfully toward the instructor, fellow students, and the studio space.

  • Handling all materials and equipment with care.

  • Following instructions promptly and adhering to all safety guidelines.

  • Refraining from disruptive behavior or any actions that could damage the space or materials.

Failure to comply with these guidelines may result in immediate dismissal from the class without a refund.

Imperfect Art Studio is committed to fostering an inclusive, welcoming, comfortable and creative space that is free of racism, homophobia, fatphobia, ableism, sexism, xenophobia, discrimination, and harassment. All individuals are not only treated with respect and dignity, have equal opportunities, and feel safe in our studio, but are celebrated for their presence. Interactions must be rooted in kindness, compassion, and empathy. All persons working or associating with our studio are expected to uphold, abide by, and stand up for this Code of Conduct; refusal will result in removal from our studio.  

At The Imperfect Art Studio, we are committed to fostering a welcoming space where artists of all backgrounds and experience levels can explore their creativity through pottery. To maintain an inclusive community, we ask everyone to be respectful and mindful of others by refraining from discussing sensitive or potentially triggering topics in the studio. While we recognize the charged nature of our world today, we strive to make the studio a safe place where aggressive behavior will not be tolerated. We reserve the right to ask individuals to leave if their actions are unprofessional. Our goal is to nurture a creative and respectful environment where everyone can focus on their artistic expression.
